President Trump’s lawyers believe that he is above the law when it comes to obstruction of justice, according to a bombshell new report in the New York Times. In a leaked 20-page letter, they have told Special Counsel Robert Mueller that Trump cannot be charged with the crime, asserting that his presidential power gives him unchecked authority over the Justice Department. The January memo, the Timesreports, “contends that the president cannot illegally obstruct any aspect of the investigation into Russia’s election meddling because the Constitution empowers him to, ‘if he wished, terminate the inquiry, or even exercise his power to pardon.’ ” The letter, which was written by Trump lawyers John M. Dowd and Jay A. Sekulow, is reportedly part of a legal campaign to prevent Trump from having to answer Mueller’s questions, or from being compelled to testify, out of fear that Trump would expose himself to another crime — lying to federal investigators — which he could be impeached for.
The lawyers also made the broad claim that “every action that the president took [amid the Russia investigation] was taken with full constitutional authority pursuant to Article II of the United States Constitution,” and thus, “these actions cannot constitute obstruction, whether viewed separately or even as a totality.” In other words, they told the special counsel that they are prepared to test the constitutional limits of Trump’s presidential powers. Trump’s lawyers insist that “Of course, the president of the United States is not above the law, but just as obvious and equally as true is the fact that the president should not be subjected to strained readings and forced applications of clearly irrelevant statutes.” But it’s not clear that Trump’s lawyers understand those statutes, or the case, as well as they purport to.
Trump’s tweet also illustrates the other central strategy being deployed by the president and his lawyers and allies, which to discredit the investigation in the eyes of the public. That game plan, Trump lawyer Rudy Giuliani acknowledged last weekend, is meant to build political support under the assumption that impeachment may be inevitable. These attacks have escalated as of late, at the same time that Giuliani and Trump’s other lawyers are trying to negotiate with, and pressure, Mueller over Trump’s possible testimony. It also suggests that their efforts to convince Mueller he cannot legally reach the president, at least when it comes to obstruction charges, have not been successful.

Essentially all presidents sooner or later end up commissioning lawyers to put forward an expansive view of presidential power, but those lawyers take pains to argue that they are notmaking the case for a totally unchecked executive whose existence would pose a fundamental threat to American values. Donald Trump, however, is a different kind of president. In a 20-page memo written by Trump’s legal team and delivered to Robert Mueller, as reported by the New York Time’s this weekend, they make an unusually frank case for a tyrannical interpretation of presidential power.
Trump’s lawyers say he has unlimited power over criminal justice…
The key passage in the memo is one in which Trump’s lawyers argue that not only was there nothing shady going on when FBI Director James Comey got fired there isn’t even any potential shadiness to investigate because the president is allowed to be as shady as he wants to be when it comes to overseeing federal law enforcement. He can fire whoever he wants. Shut down any investigation or open up a new one.
Indeed, the President not only has unfettered statutory and Constitutional authority to terminate the FBI Director, he also has Constitutional authority to direct the Justice Department to open or close an investigation, and, of course, the power to pardon any person before, during, or after an investigation and/or conviction. Put simply, the Constitution leaves no question that the President has exclusive authority over the ultimate conduct and disposition of all criminal investigations and over those executive branch officials responsible for conducting those investigations.
This is a particularly extreme version of the “unitary executive” doctrine that conservative legal scholars sometimes appeal to (especially when there’s a Republican president), drawing on the notion that the executive branch of government — including the federal police agencies and federal prosecutors — are a single entity personified by the president. But to push that logic into this terrain would not only give the president carte blanche to persecute his enemies but essentially vitiate the idea that there are any enforceable laws at all.
Trump Lawyers Admit To Collusion & Obstruction!
This is the part where Trump crimes were most apparent. President Donald Trump, according to his own lawyers, helped deceive the public about the now-infamous Trump Tower meeting between top campaign officials and a Kremlin-linked lawyer. The revelation came in a 20-page memo obtained by the New York Times, which Trump attorneys John Dowd and Jay Sekulow sent to Special Counsel Robert Mueller on Jan. 29, 2018. The memo argues that the special counsel does not have the power to subpoena the president, and that White House officials and document production have already told Mueller and his team everything they could learn from interviewing Trump. The memo lists 16 topics Mueller’s team purportedly wants to discuss with the president, including “[t]he statement of July 8, 2017, concerning Donald Trump, Jr.’s meeting in Trump Tower.”
That meeting—first revealed by the Times—generated massive public outcry. The meeting brought Donald Trump Jr., Jared Kushner, and then-campaign chairman Paul Manafort together with Natalia Veselnitskaya, an attorney with close Kremlin ties. The Trump campaign officials went into the meeting after being promised that Veselnitskaya and other Russians who attended with her would have damaging information on Hillary Clinton. But instead, Veselnitskaya pushed for the lifting of sanctions on Russian officials. Kushner, according to later Congressional testimony from one of the participants, was outraged that the Russian attendees didn’t bring Clinton dirt. When the news of the meeting was breaking, Trump reportedly participated in drafting a statement saying the purpose of the meeting was to talk about adoptions.

For nearly a year, the White House repeatedly has claimed that President Donald Trump did not write his son’s statement explaining why he and other campaign advisers had met with a Russian lawyer offering dirt on Hillary Clinton. A new memo from his legal team now admits that this was a lie. The July 2017 statement, purportedly from the president’s eldest son, made the claim that he, his brother-in-law Jared Kushner, and then-campaign chairman Paul Manafort had met Natalia Veselnitskaya, a Russian lawyer with close ties to Vladimir Putin, for a June 9, 2016 meeting where they “primarily discussed a program about the adoption of Russian children.”
According to the New York Times, Trump’s legal team wrote in a January 29, 2018 memo to Special Counsel Robert Mueller: “You have received all of the notes, communications and testimony indicating that the President dictated a short but accurate response to the New York Times article on behalf of his son, Donald Trump, Jr. His son then followed up by making a full public disclosure regarding the meeting, including his public testimony that there was nothing to the meeting and certainly no evidence of collusion.” The statement was written by Trump lawyers John Dowd and Jay Sekulow. But last summer, Sekulow himself went on Meet the Press and said the exact opposite. Contradicting a story by the Washington Post that same day titled “Trump dictated son’s misleading statement on meeting with Russian lawyer,” Sekulow falsely averred that President Trump “was not involved in the drafting of the statement” and that it “came from Donald Trump Jr.”
Don Jr. told Congress in December that he did not communicate with his father about the statement. White House press secretary Sarah Huckabee Sanders claimed in August that the president merely weighed in, “as any father would.” Another of Trump’s lawyers, former New York City Mayor Rudy Giuliani (R), told ABC’s This Week on Sunday that the shifting explanations show why Trump shouldn’t be allowed to testify before the Special Counsel: “Our recollection keeps changing, or we’re not even asked a question and somebody makes an assumption.” At the time, President Trump praised his son’s statement — the one his lawyers now admit he wrote — saying that Don Jr. “is a high-quality person and I applaud his transparency.”

Jeff Sessions Pressured

President Trump pressured Attorney General Jeff Sessions to reclaim control of the Russia investigation on at least four separate occasions, three times in person and once over the phone, according to sources familiar with the conversations. The fact that there were multiple conversations shows that Trump’s pressure on Sessions to stop recusing himself was heavier than previously known. The sustained pressure made several officials uncomfortable, because they viewed it as improper and worry that it could be politically and legally problematic. The New York Times this week reported on one of these conversations— which occurred at Mar-a-Lago in March 2017 — and said Robert Mueller is investigating it. But Trump’s other direct conversations with Sessions about the subject have not been previously reported. A source with knowledge of the conversations said they occurred throughout last year, until fairly late in the year — not just in the short period after Sessions recused himself last March.

Two days ago, the New York Times reported that President Trump berated Attorney General Jeff Sessions for recusing himself from the Russia investigation. (The recusal was a slam dunk, as Sessions had a clear and glaring conflict of interest in an investigation of a campaign he was part of on a subject he misled Congress about.) Now Jonathan Swan reports that Trump did not give up when the recusal was explained to him. He urged Sessions to take back control of the Russia investigation at least four separate times, “until fairly late in the year.” Trump tried to tell Sessions that he would be “a hero” to Republicans if he “did the right thing” — not only on the investigation of Trump, but also by opening up investigations of Trump’s Democratic enemies. “Much of his desire for investigating Clinton and Barack Obama comes from a desire for retribution,” people who have discussed this with the president tell Swan. This falls into the category of “shocking, but not surprising,” the kinds of Watergate-level abuses of power we learn about every week. Trump believes he is entitled to run the federal law-enforcement apparatus for his personal and political benefit, sparing his friends and subjecting his allies to merciless harassment. Trump is incorrigibly authoritarian, and the conservative habit of analyzing this conflict as if Trump is not bent on corrupting law enforcement into an authoritarian tool is a way of avoiding the central issue. The Constitution is not going to be safe as long as Trump occupies the Oval Office.

Trump’s revisionist history might provide himself and his cultist followers with temporary comfort. Trump is infamous for inventing his own reality — and his apologists are infamous for swallowing whatever he puts out, no matter how untethered to reality or self-contradictory his statements are. The mainstream media’s job is to report the current statement and the contradictory statements so that the rest of the public can see for itself Trump’s pattern of deception. The only audience that really matters is Mueller. He is likely collecting a pile of evidence, much of it unknown to Trump, to piece together a picture of an ongoing effort to obstruct the Russia investigation. Mueller can slot the latest tweet into place. For voters, Trump’s constant lies may be infuriating; for Mueller, they should be an embarrassment of evidentiary riches.
