A Trump Coup on America looks to be His Desired Mission….Trump has been an accomplished professional con man for decades. Chronic dishonesty plays into his con. He has this unique ability to make his lies sound so convincing, others willingly follow along. He’s become so good at it, he might even be convincing himself: New-York-Times-adopts-George-Costanza-policy-on-what-is-and-isn-t-a-lie. As a businessman, his shyster nature was mostly contained to business associates. As president the damage is far more widespread, waging a war against truth, justice & democracy. Signs of a Trump coup were abundantly clear from a memo released over the weekend, where Trump’s legal team made several dangerous threats claiming he’s above the law, stating specifically he can’t be subpoenaed, can’t be indicted, can’t be charged with obstruction, but he can pardon himself!
This is outrageous! They’re claiming absolute power! But nobody is above the law! Plus his lawyer just said our leader can legally commit murder on the former FBI Director!: scarborough-on-giulianis-trump-shoots-comey-hypothetical-out-of-a-tyrants. This is beyond crazy!!! The White House has seemingly become evil personified. Are we becoming a fascist regime like Russia or North Korea?: we-need-to-rethink-how-we-talk-about-fascism. The newly leaked memo by Trump’s lawyers, obtained by the New York Times, suggests that such a crisis is not merely a likelihood, but that it has already begun. The memo proposes several tendentious interpretations of the publicly available facts of Trump’s behavior, along with some legally questionable and amateurish citations of precedent. But the most important passage is its sweeping assertion of presidential authority. “The President not only has unfettered statutory and Constitutional authority to terminate the FBI Director, he also has Constitutional authority to direct the Justice Department to open or close an investigation, and, of course, the power to pardon any person before, during, or after an investigation and/or conviction,” they write, “Put simply, the Constitution leaves no question that the President has exclusive authority over the ultimate conduct and disposition of all criminal investigations and over those executive branch officials responsible for conducting those investigations.”
They did indeed put it simply. The implications of this authority are breathtaking. Trump, in their view, has unlimited control to open or close any federal investigation. Trump has been angrily tweeting demands that the investigation into him and his allies be halted, and that the Department of Justice instead open investigations into his political enemies. These tweets have been treated as the ravings of a blowhard who just happens to occupy the most powerful position in the world, yet is somehow merely blowing off steam. His lawyers are fully endorsing Trump’s right to do exactly the thing he is calling for. Trump’s lawyers are saying that he should be taken seriously and literally. Should Trump’s legal case prevail in the courts — and the legality of such broad claims remains largely untested — it would confer upon any president, but immediately Trump, the ability to open charges against anybody the president wants to charge, and prevent investigations of anybody the president wants to protect, beginning with himself. This is l’état, c’est moi rendered as a formal legal case.
Indeed, the conclusion of the memo hints a even more expansive uses for the terrifying powers Trump has claimed. “Every action that the president took was taken with full constitutional authority pursuant to Article II of the United States Constitution,” they write, “As such, these actions cannot constitute obstruction, whether viewed separately or even as a totality.” Article II of the Constitution establishes the Executive Branch, which has numerous other offices, some quite powerful. The Internal Revenue Service lies within Article II. Trump’s lawyers would seem to believe the president can direct the IRS to open or close any tax audit of any figure the president wants to subject to, or protect from, scrutiny. Trump cannot obstruct justice, according to his official legal stance, because justice is whatever Trump says it is. Before this is over, either Trump’s sweeping claim will survive, or the rule of law will, but not both.

When he virtually stalks and hounds Attorney General Jeff Sessions, he is waging war against Sessions. When he berates and insults Deputy Attorney General Rod Rosenstein, he is waging war against him. Among the vast number of voters who have made Trump extraordinarily unpopular, these vicious attacks against bastions of American justice that Trump treats as enemies create anger, alarm and outrage. They believe, in large numbers, that something has gone terribly wrong with America under Trump. They fear, very deeply, that something very dangerous is happening in America under Trump and Republicans who back him. They will vote in November in huge numbers to create the check and balance against Trump that they crave and believe is not being offered by Republicans in Congress.

I admit that I am an absolute radical when I express the danger the Republican fascist cult presents to our democracy. A clear line has been drawn with the release of Trumps legal memo. Make no mistake, it is a direct attack on the rule of law and a declaration of absolute power on the part of the President. It’s thesis must be attacked relentlessly. The American Republic is worth fighting for.
Any member of Congress that supports the legal thesis of the Trump letter is a friend of illiberalism and unfaithful to their constitutional oaths. There is no room for debate or disagreement here. Supporting this crazy theory is an assault on the Republic.

Christians Should Be Honest & Not Follow Liars, Being Forewarned about the Father of Lies
Among the many ways Trump’s moral failings are on display, he refuses to apologize for anything. It even goes back to the campaign when during an interview he was asked if he ever asked forgiveness from God, to which he replied no because he never needed to. Does that mean he considers himself perfect & has never sinned? And this has become the leader many evangelicals seemingly worship?: meghan-mccain-slams-white-house-this-is-not-an-administration-thats-capable-of-apologizing. The Christian church must get back to the moral teachings of Christ: Reclaiming-Jesus-not-all-Christians-support-the-republican-agenda & also what-about-jesus, which although my beliefs don’t necessarily align with this group’s specific theology, it still offers core beliefs which are a welcome respite from the spirit of deception which seems to have possessed Trump evangelicals. I would like to offer up very instructive passages from Proverbs 29: Sunday-words-for-christians-for-Trump-are-you-reading-what-has-been-written. And let me also present you with more scripture:

A couple questions can evolve from that verse. If Satan is the “father of lies,” what does that make our nation’s leader who lies more than any other person we know? Is he his servant? I’d also like to ask my brethren (having served as an usher in a typically white evangelical church for 20 years), if you’re serving such a deceitful earthly king with unconditional trust & adoration, what does that make you? Perhaps one day through honest evaluation, contemplation, discernment & prayer, you’ll come to view Trump as I see him, which is literally displayed in his picture from inside A-wonderful-screed-from-Charles-M-Blow. This is a man so manifestly lacking in moral character, he’s an embarrassment to our nation. It’s also embarrassing for evangelicals to be seen as tied to him, as if rogue politics is part & parcel to the faith. Regardless of political ideologies or winning court cases over cultural issues, it’s ultimately going to backfire over time when hitching our wagons to an earthly leader who follows the example of the one from which Jesus warned for he is a liar and the father of lies.

Ok, I normally don’t discuss politics with clients, but since you asked: Trump is the most appallingly unprepared, unqualified person ever “elected” (he didn’t win the popular vote) to the presidency. He is dishonest to the core, an ignorant, vulgar, bigoted megalomaniac. He is an authoritarian with a taste for revenge, who has nothing but contempt for democracy, the Constitution, and the rule of law – subjects he knows nothing about in any case. He neither knows nor cares about science. He will put criminals and crackpots in charge of government agencies. The Supreme Court will be packed with right-wing ideologues who will ensure that all manner of fringe legal theories will become legally enforceable. Trump’s presidency will make the Bush nightmare look like America’s halcyon days.
Russia – aided by an astonishingly unprofessional FBI director James Comey — succeeded in swaying just enough votes to swing the election. Yesterday the Russian Foreign Ministry actually confirmed that Russia had worked with the Trump campaign to help get him elected. For months the Trump campaign had vigorously denied this even after it had to fire campaign manager Paul Manafort after his ties with Putin and pro-Putin Ukrainians were discovered. Russia also officially confirmed that it was indeed behind the hacked Democratic Party servers and the leaking of emails to try to change the talking points by creating controversy about Clinton while suppressing anything negative about Trump. Imagine if something like that had surfaced regarding Obama or Clinton during their campaigns – the right wing would have gone apoplectic – but now all we hear is crickets. The Russians have cultivated Trump for years; they know he can be manipulated to allow them to gain the upper hand in whatever areas they wish. Trump is, as the Russian saying goes, Putin’s “useful idiot”: Полезный дурак Путина. I have a number of clients who also wanted to discuss politics with me this past couple of days, and who are elated that Trump won. Their reasons seem to be:
*They think our country is being overrun by Muslims or will be, and they want to avoid a situation like in Europe. That’s a legitimate concern, since non-Europeans are indeed pouring into Europe and refusing to assimilate. I have traveled and lived in Europe and have seen it with my own eyes. It threatens to destroy the fabric of society there. But we don’t have that problem: One reason is that we control immigration. We let in the best and brightest, and a tiny trickle of refugees, and that’s about it. In Europe, by contrast, uneducated people from countries that never advanced beyond the 13th century can just take the train or drive and sneak in. Also, non-Europeans flood into Europe from former French, etc. colonies such as Tunisia – a problem we don’t have. Immigrant Muslims here in the States are assimilating far more than in Europe, in part because we don’t relegate Muslims to ghettos; we welcome them into our neighborhoods. We have two first-generation Muslim families on our street. The wife in one of them wears a headscarf, but otherwise they’re not much different than anyone else. Our kids play together. We get together socially.
*They hate Obamacare because it is killing small businesses. Obamacare is a classic example of that saying, “a camel is a horse designed by a committee.” It leaves a lot to be desired but it is far better than nothing. As I’m sure you know, it’s just Romneycare on a national scale — a Republican plan designed to privatize health care by delivering 20 million new customers to insurance companies. It works fairly well in Massachusetts. But once the Democrats abandoned Medicare for all and instead passed Obamacare as the price for getting Joe Lieberman’s crucial vote, Republicans did everything possible to sabotage and obstruct it, just as they have sabotaged and obstructed everything Obama has tried to do from day one. The result is that the costs for small business are higher than they would have been – even though Obamacare has already resulted in a huge reduction in overall health care costs: $2.6 trillion savings over the first 5 years. For the life of me, I can’t understand why Congress doesn’t just enact Medicare for all – it would be financed by payroll tax deductions and small businesses wouldn’t have to contribute a dime. And the result would be even greater overall savings.
*They think Clinton is a “liar” and “corrupt,” but all they know is the propaganda they have been fed for decades by right-wing hate media. They think her speaking fees make her corrupt but couldn’t care less about the fact that Trump stiffed thousands of people who sold him goods and services. They think she is a liar because she mischaracterized something James Comey said (which he shouldn’t have discussed in the first place), but overlook the daily deluge of lies coming out of Trump’s mouth. I have followed the Clintons and the right-wing vendetta against them ever since I was in law school 33 years ago. Hate media (Fox, Rush, Savage, Jones, Drudge, Breitbart, Falwell Jr. et al.) use exactly the same propaganda techniques used by Goebbels in the 1930s and by Radio Moscow in the 1970s-1990s, only slicker. And people eat it up. In fact, these past few months it was hard to tell the difference between the Russian state-controlled media and Fox News. Both sounded just like the old communist Radio Moscow, using their usual propaganda techniques, but this time to shamelessly promote Trump and just as shamelessly denigrate Clinton. In reality, Hillary Clinton has dedicated her life to public service, to the betterment of the country. She is comprehensively knowledgeable about public policy and the world (an in particular is under no illusions about Russia), and knows how to get things done in a bipartisan manner. She is as honest as any politician can be. I’ve had a top secret clearance and worked in intelligence, and the email circus was just that.
*There is definitely a racial and misogynist component. One client, who laughed that Clinton got “spanked” and said he and all his friends talk like Trump all the time, and see nothing wrong with it. Over the past eight years I’ve heard a lot of vile, disgusting racial stuff about Obama and Michelle Obama. We aren’t nearly as civilized as I had hoped.
The world order is fragile. Democracy is fragile. The Trump presidency will be an unmitigated disaster. Our country and the world are in more danger now than at any time since the Cuban Missile Crisis. For me as an attorney, I feel as though my country has just died. White supremacy has emerged again. Vast numbers of uneducated white men have gleefully voted with their middle finger. Every great nation has its rise and its decline. Trump’s election may well mark the beginning of the decline of the United States as a great nation.
